Buying a Yacht
The Sales & Purchase Agreement
All boats presented are belonging to an owner who asked us himself or through his representative to sell his boat. We hold, at the disposal of the potential buyer a listing describing the boat as well as it's inventory and photos.
If a potential buyer is interested in the boat and wishes to inspect it himself or through a representative, we organize this inspection.
It is indispensable for the potential buyer to complete and sign a "purchase agreement". This document, signed by both parties is an agreement on a "Selling " price. (As per the offer made by the potential buyer and accepted by the seller).
It guarantees to the seller that the inspection of his boat is going to be supervised by a broker at a preselected date and place , as well as protecting the buyer by insuring that the boat he is going to see in the very same boat he selected on our listings.
This document defines the base of the sale and guarantees the security of the transaction. Upon making an offer, the buyer has to put 10% downpayment of the agreed price into the escrow account of the broker representing him.
This deposit does not only show the seriousness of the buyer but prevents the seller to accept any other offers coming from other potential buyers, even if the offer is superior to the one in effect until a date which has been defined on the purchase agreement.
If this deposit is not made, the buyer does not have a formal contract or a reserve on the yacht and the owner is free to accept any other offers that are made.
The buyer then has a set time in order to have the yacht surveyed (we can propose a list of qualified surveyors if needed) at his expense as well as scheduling a sea trial (we organize your visit ). The owner supplies and pays for the skipper.
At the agreed date, the buyer has the following options.
He rejects the boat and his deposit is immediately refunded.
He accepts the boat and a date, as defined in the purchase agreement, is set for
The owner then provides the relevant documents of ownership, that all eventual liens have been paid and is administratively ready to be registered wherever the buyer wishes at his own expenses.
We can assist you with all the formalities regarding customs, merchant navy, flag, bill of sale, transfer of ownership etc… request for a personalize quotation. The sale becomes final when the owner is fully paid after receiving the completed documents for registration under your name.
Whether you are looking for a high end superyacht, a luxury motor yacht, or sailing yacht, we will be more than happy to assist. By researching all vessels currently on the market through multiple listing systems and other industry resources, we will make it happen. After determining that a particular yacht fits your requirements, we then discuss negotiating strategies, and formulate a purchase agreement.
When a successful agreement is reached, we will assist you in arranging sea trials and surveys which may include mechanical, electrical, electronics, and hull inspections.
Financing, insurance, tax, duty, dockage, and other pre-closing considerations are discussed and evaluated. A proper course is set, often with the assistance of a maritime attorney and/or documentation or customs agent. Also, prior to closing, we can assist in interviewing for captain & crew and discuss chartering the vessel, if appropriate, and arranging delivery of your new vessel.
